Standard Terms of Trade

For Clients, Licensors and Licensees of the InStyle Bathrooms & Renovations Network

Independent Licensee Acknowledgment

Each InStyle Bathrooms & Renovations Licensee operates as an independent business. All agreements, contracts, quotations, warranties, and obligations are between the client and the individual Licensee or contracted renovation business engaged to carry out the works.

Services, pricing, promotions, project inclusions, and contract terms may vary between Licensees. InStyle Bathrooms & Renovations Pty Ltd, its Licensor, and affiliated entities are not direct parties to renovation contracts except where required by law.

1. Services Offered

InStyle Bathrooms & Renovations provides bathroom, kitchen, laundry, ensuite, and residential renovation services including design consultation, product sourcing, project management, demolition, installation, and renovation works.

Some Licensees may offer additional services such as 3D design concepts, virtual reality visualisations, interior design assistance, or custom renovation packages. Availability of these services may vary by location and Licensee.

From time to time, promotional pricing, discounts, package offers, or special campaigns may be advertised. Such promotions may be amended, suspended, or withdrawn without notice and may be subject to specific terms and conditions. Participation in promotional offers remains at the discretion of individual Licensees.

2. Estimates and Quotes

Free estimates and quotations may be provided based on information supplied by the client.

All estimates are indicative only and may change due to project scope, site conditions, structural requirements, material selections, supplier pricing, labour costs, council requirements, strata requirements, or other unforeseen circumstances.

A final written quotation, proposal, or building contract will be provided before works commence.

3. Scope of Works

Advertised renovation packages and pricing are based on standard residential conditions and are provided as a guide only.

Any advertised “from” pricing represents a starting price and does not constitute a fixed quotation. Final project costs will depend on site inspection, selections, access requirements, project complexity, and individual client requirements.

Additional works outside the standard scope may include:

  • Structural modifications
  • Asbestos removal
  • Waterproofing rectification
  • Electrical upgrades
  • Plumbing upgrades
  • Apartment or multi-level access requirements
  • Body corporate or strata compliance requirements
  • Hidden site conditions

Any unforeseen issues discovered during demolition or construction may require additional work and may result in variations to both cost and completion time.

4. Variations and Prime Cost Allowances

Any variation to the agreed scope of works must be approved in writing before commencement.

Where Prime Cost Allowances or Provisional Sums are included within a quotation, any selections exceeding those allowances will be charged as a variation.

Variations may affect project pricing, scheduling, and completion dates.

5. Payment and Billing

Deposits are payable in accordance with applicable state and territory legislation.

Progress payments may be required at agreed project milestones, including demolition, waterproofing, tiling, cabinetry installation, fit-off, and practical completion.

Final payment is due upon completion of the project unless otherwise agreed in writing.

Failure to make payments when due may result in suspension of works, recovery action, and any reasonable costs associated with collection of outstanding amounts.

6. Project Timeframes and Delays

Project commencement and completion dates are estimates only.

InStyle Bathrooms & Renovations and its Licensees are not responsible for delays caused by factors beyond reasonable control, including:

  • Material shortages
  • Supplier delays
  • Extreme weather
  • Council approvals
  • Strata approvals
  • Industrial action
  • Client-requested changes

Client delays, including late selections, restricted access, or failure to provide required information, may result in additional costs and revised completion dates.

7. Warranty and Guarantees

A 12-month workmanship warranty applies to renovation works unless otherwise specified within the building contract.

This warranty covers defects arising directly from workmanship.

Statutory warranties required under relevant state and territory building legislation remain applicable, including warranties relating to major and minor defects where prescribed by law.

Manufacturer warranties apply separately to fixtures, fittings, appliances, and materials supplied.

Warranty coverage excludes damage resulting from:

  • Misuse
  • Neglect
  • Lack of maintenance
  • Accidental damage
  • Water ingress from external sources
  • Inadequate ventilation
  • Normal wear and tear

Warranty claims must be directed to the Licensee or contractor who performed the renovation works.

8. Client Responsibilities

The client must provide reasonable site access, including access to water, electricity, parking, and safe working conditions.

Work areas should be cleared of personal belongings before commencement.

Following project completion, clients are responsible for maintaining the bathroom and associated fixtures, including ventilation systems, silicone joints, grout, sealants, and general cleaning.

Clients must not engage third-party contractors to interfere with, alter, or complete works forming part of the contracted renovation scope.

9. Deposits and Cancellations

Deposits are generally non-refundable except where required by law.

Where cancellation occurs prior to commencement, a partial refund may be considered after deduction of reasonable costs incurred, including administration, design work, site inspections, material ordering, and scheduling expenses.

If cancellation occurs after works commence, the client remains responsible for payment of completed works, materials purchased, and costs incurred up to the cancellation date.

InStyle Bathrooms & Renovations or the Licensee may terminate the agreement where the client breaches contractual obligations, including non-payment, unsafe site conditions, or refusal to provide reasonable access.

10. Dispute Resolution

Any dispute should first be submitted in writing to the Licensee responsible for the project.

Where a resolution cannot be achieved, the matter may be escalated to InStyle Bathrooms & Renovations management for review.

The parties agree to make reasonable attempts to resolve disputes through negotiation and mediation before commencing tribunal or court proceedings.

Nothing in this clause limits a party’s rights under applicable consumer protection or building legislation.

11. Marketing and Photography

InStyle Bathrooms & Renovations may photograph completed projects for marketing, training, educational, social media, or promotional purposes.

Clients may opt out by providing written notice before commencement of works.

No personal or identifying information will be published without consent.

12. Privacy Policy

We respect your privacy and manage personal information in accordance with applicable Australian privacy laws.

Information collected may be used for quotations, project management, customer service, warranty administration, compliance requirements, and marketing communications where consent has been provided.

13. Limitation of Liability

To the fullest extent permitted by law, InStyle Bathrooms & Renovations and its Licensees exclude liability for indirect, consequential, incidental, special, or financial losses arising from the provision of services.

Our total liability for any claim relating to the project shall not exceed the total amount paid by the client under the contract, except where prohibited by law.

Nothing in these Terms excludes rights available under Australian Consumer Law.

14. Governing Law

These Terms are governed by the laws of the Australian state or territory in which the renovation works are carried out.

Any disputes shall be subject to the jurisdiction of the relevant courts, tribunals, and regulatory authorities within that jurisdiction.

15. Acceptance of Terms

By submitting an enquiry, requesting a quotation, signing a proposal, entering into a building contract, or engaging an InStyle Bathrooms & Renovations Licensee, the client acknowledges that they have read, understood, and accepted these Terms of Trade.
